Beetnic Terms of Service


1.Your Acceptance of these Terms and Representations you Provide


These Terms of Service ("Terms") shall constitute an Agreement between you and Beetnic. Your use of any part of beetnic's Service, which includes this Site and any of its related features and tools, will signify your acceptance of these Terms in full, whether you are a registered user or unregistered user. Also, in order to use or continuing using this Service as a member, you must provide true, accurate, current and complete information as may be requested by Beetnic.

2.Age Requirements


You must be at least 13 years old to use this service. We apologize for any inconvenience this may cause. Beetnic does not provide content directed toward children and Beetnic's Service is not currently intended for use by children. We do not monitor, screen, nor pre-approve content provided by users. If you are a parent, we encourage you to monitor your child's use of the Internet and to block access to any sites you may feel are inappropriate for your child.

3.Ownership of Code and Content


Beetnic does not claim any ownership rights in the Content or the Code you provide. You, as the Network Creator, own the Code you develop ("your Code"). You also own the Content you create and upload ("your Content"). After posting your Content or your Code, you continue to retain all ownership rights in such Content or Code, and you continue to have the right to use and license your Content and your Code in any way you choose.

These Terms of Service includes a number of licenses that are necessary for Beetnic to make your Network and your Content available through the Beetnic Platform. For example, without the right to modify Content, Beetnic would not be able to format Content to meet technical requirements, and without the right to publicly perform or publicly display Content, Beetnic could not make the Content available for other Users to view.

4.User Content Posted on the Site


You may submit to us copies of works of authorship such as pictures or songs or videos("Content"). You retain all ownership rights to any Content posted to or transmitted by you through the Service to which you are entitled by law. We do not claim any ownership rights to any Content posted to or transmitted by you through the Service. However, by uploading Content to one of our Sites, you grant (or represent and warrant to us that the owner of the copyright has granted) to us a perpetual, royalty-free, irrevocable right and license to display, perform, reproduce, adapt, and distribute such Content, and to incorporate such Content into any form, medium, or technology now known or later developed. In addition, you represent and warrant to us that all so-called moral rights in the Content have been waived.

Beetnic reserve the right to take action to prevent the misuse of the Service for unlawful or objectionable content. Accordingly, you agree not to use the Service to post, upload, or transmit any Content that is:


  • (1) unlawful under the laws of any jurisdiction to which you or Beetnic are subject;
  • (2) harmful, threatening, harassing, defamatory, invasive of the privacy of another, or obscene (including without limitation any images or depictions of child abuse, child pornography, or minors engaged in sexual conduct or explicitly sexual situations);
  • (3) insider information, or any other proprietary or confidential information;
  • (4) an infringement of any patent, trademark, trade secret, copyright or other intellectual property right;
  • (5) falsified, including without limitation the use of forged headers or otherwise manipulated identifiers in order to disguise its origin; or
  • (6) containing or transmitting software viruses or any other malicious computer code, files or programs designed to gain unauthorized access to a computer, or to interrupt, destroy or limit the functionality of any computer software. You agree to indemnify and hold harmless MyStrands from any liability incurred as the result of your violation of these Terms, in accordance with the applicable provisions of these Terms.

5.User Submitted Comments, Suggestions and Ideas


Comments, feedback, suggestions, or ideas submitted to Beetnic (collectively "Comments") are not "Content" as defined above. In consideration of your use of the Sites and Services, you hereby assign all right, title and interest in and to such Comments to Beetnic. If you are aware of a patent, pending or issued, that may cover the Comments you submit, or affect their use or implementation, please include that information in your submission.

6.Use of Services


Your use of the Services is at the sole discretion of Beetnic, which may deny you further use of the Services at any time, for any reason, with or without cause, including, without limitation, for your violation of this Agreement, failure to provide accurate registration data, or lack of use. In the event of termination, all representations, warranties, indemnifications, and promises made by you will survive. Your use of the Services must always comply with applicable law, including but not limited to all laws respecting copyright. You agree not to use the Services to impersonate any person or entity, or to falsely state or otherwise misrepresent your affiliation with any person or entity.

Unauthorized use of the Services includes collecting usernames, email addresses, or other personal information of members for any commercial purpose, including but not limited to advertising, marketing, and sending of unsolicited email about any goods or services. You are also not authorized to present any of the Sites, or any part of any of the Sites, in a "frame" or inline link on any other site. Unauthorized or illegal uses of the Sites and Services will be investigated, and appropriate legal action will be taken.

7.Our Compliance With Copyright Law


We will comply with all applicable laws respecting copyright. If you believe your copyright in a work has been infringed through one of our Sites, please contact our agent for notice of claims of copyright violation:

8.Dealing with others


You may interact with others through this Service. You agree that those interactions with others on or through this Service, including any transactions with others, do not involve Beetnic and are solely between you and the other(s). You understand that the comments or material of others that identify your content or are displayed in connection with your content may be disparaging, defamatory, embarrassing, or otherwise unfavorable, which could expose you to public ridicule, humiliation or condemnation. Beetnic expressly disclaims any liability for any such third party actions whatseover, including such comments or material they may provide.

9.Privacy


We care about the privacy of our users. By using the Site or the Service, you are consenting to have your personal data transferred to and processed in France.

Your use of this Service signifies your agreement to our privacy policy, including consent to allow any information you provide to us to be used in the manners consistent with those listed in our policy. Also, Beetnic may disclose any information collected about the members of this Service, if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to legal process, or in the good faith belief that such disclosure is necessary to enforce these Terms, respond to claims that any Content violates the rights of third-parties, respond to claims that contact information of a third-party has been posted or transmitted without their consent or as a form of harassment or to protect the rights, property, or safety of Beetnic, its users or the general public

10.Disclaimers


Beetnic is not responsible or liable in any manner for any User Content or Third Party Applications, Software or Content posted on the Site or in connection with the Service, whether posted or caused by users of the Site. Although we provide rules for user conduct and postings, we do not control and are not responsible for what users post, transmit or share on the Site and are not responsible for any offensive, inappropriate, obscene, unlawful or otherwise objectionable content you may encounter on the Site or in connection with any User Content or Third Party Applications, Software or Content. The Company is not responsible for the conduct, whether online or offline, of any user of the Site or Service.

The Site and the Service may be temporarily unavailable from time to time for maintenance or other reasons. Company assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, User communications. The Company is not responsible for any technical malfunction or other problems of any telephone network or service, computer systems, servers or providers, computer or mobile phone equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any Site or combination thereof, including injury or damage to User's or to any other person's computer, mobile phone, or other hardware or software, related to or resulting from using or downloading materials in connection with the Web and/or in connection with the Service, including without limitation any Mobile Client software. Under no circumstances will the Company be responsible for any loss or damage, including any loss or damage to any User Content or personal injury or death, resulting from anyone's use of the Site or the Service, any User Content or Third Party Applications, Software or Content posted on or through the Site or the Service or transmitted to Users, or any interactions between users of the Site, whether online or offline.

11.Entire Agreement


This Agreement, together with any End User License Agreement between you and Beetnic and the Referral Agreement, if any, constitutes the entire agreement between you and us with respect to your use of the Services and Sites. There are no other representations, warranties, terms, agreements or conditions, either written or oral, with respect to your use of the Services and Sites, except as set forth in this Agreement and the End User License Agreement, if any.
